End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and ColPath (developed and operated by Ashrith Padi, contact: appteams.ops@gmail.com, referred to as "we", "us", or "Licensor") for the use of the ColPath mobile application ("App" or "Software").

1. Grant of License

1.1 License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device(s)
• Use the App for personal, non-commercial purposes
• Access the features and services provided by ColPath

1.2 License Restrictions

This license does NOT grant you the right to:

• Sell, rent, lease, sublicense, or transfer the App to any third party
• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Remove, alter, or obscure any proprietary notices or labels on the App
• Use the App for any commercial purposes without written permission
• Distribute or make the App available over a network where it could be used by multiple devices

2. Free Service

ColPath is provided as a completely free service with:

• No subscription fees
• No in-app purchases
• No hidden costs or charges
• No premium features requiring payment

All features of the App are available to all users at no cost.

3. Ownership and Intellectual Property

3.1 App Ownership

ColPath and all associated intellectual property rights remain the exclusive property of the Licensor. This includes:

• Software code, algorithms, and architecture
• User interface design and graphics
• Trademarks, logos, and brand elements
• Documentation and content
• Database structures and data compilations

3.2 Your Content

You retain ownership of any content you create or submit through the App. By using the App, you grant us a license to use your data solely for providing and improving the service.

4. Account Registration and Use

4.1 Account Creation

To use ColPath, you must create an account by providing:

• Email Address: For account identification and communication
• Firebase Authentication: For secure login and account management
• Firebase UUID: Automatically generated unique identifier

4.2 Age Requirements

• You must be at least 13 years old to use ColPath
• Users under 18 must have parental or guardian consent
• We may request age verification at any time

4.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. Data Collection and Privacy

5.1 Data We Collect

By using ColPath, you consent to the collection and processing of:

• Email Address: For account management
• Firebase UUID: For user identification
• Location Data: For map-based features and college recommendations
• App Usage Data: For service improvement
• Crash Reports: Via Firebase Crashlytics for stability monitoring

5.2 Third-Party Services

ColPath integrates with the following third-party services:

• Firebase Authentication: User authentication and account management
• Cloud Firestore: Data storage and synchronization
• Firebase Crashlytics: Crash reporting and diagnostics
• Mapbox Maps: Interactive maps and location services

These services have their own privacy policies and terms of service. We are not responsible for their data practices.

5.3 No Sensitive Data

Important: ColPath does NOT collect, store, or process:

• Financial information (credit cards, bank accounts)
• Health or medical data
• Government-issued identification numbers (SSN, passport, etc.)
• Biometric data
• Any other sensitive personal information

5.4 Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into this EULA by reference. Please review our Privacy Policy to understand our data practices.

6. Location Services

6.1 Location Permission

ColPath uses Mapbox Maps to provide location-based features. By granting location permission, you agree to:

• Allow the App to access your device's location data
• Display your location on interactive maps
• Receive location-based college recommendations

6.2 Disabling Location

You can disable location services at any time through your device settings. However, this may limit certain features of the App.

7. Acceptable Use and Prohibited Conduct

7.1 Permitted Use

You may use ColPath to:

• Search and explore colleges and universities
• View college information and details
• Track your college search history
• Manage application deadlines and reminders
• Use location-based features to find nearby colleges

7.2 Prohibited Conduct

You must NOT:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights
• Upload viruses, malware, or malicious code
• Attempt to hack, compromise, or exploit the App
• Use automated bots, scripts, or scrapers
• Misrepresent your identity or impersonate others
• Spam, harass, or abuse other users
• Interfere with or disrupt the App's operation
• Collect or harvest user data without consent

8. Disclaimers and Warranties

We specifically disclaim all warranties, including but not limited to:

• Merchantability: That the App is suitable for any particular purpose
• Fitness for Purpose: That the App will meet your specific requirements
• Non-Infringement: That the App does not violate third-party rights
• Accuracy: That college information is current, complete, or error-free
• Uninterrupted Service: That the App will be available 24/7 without downtime
• Error-Free: That the App will be free from bugs or defects
• Security: That the App is completely secure from unauthorized access

8.2 Content Disclaimer

ColPath provides college information for educational purposes only:

• We do not guarantee the accuracy or completeness of any college data
• Information may become outdated or incorrect
• You should verify all information directly with colleges
• We are not responsible for decisions made based on App information

9. Limitation of Liability

9.1 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLPATH AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption or lost opportunities
• Personal injury or property damage
• Errors, mistakes, or inaccuracies in content
• Unauthorized access to your account or data
• Interruption or cessation of service
• Third-party conduct or content

9.2 Maximum Liability Cap

Our total aggregate liability for all claims related to the App shall not exceed $100 USD or the amount you paid to use the App (which is $0, as ColPath is free), whichever is greater.

9.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such cases, the above limitations may not apply to you, and our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless ColPath, its developers, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to:

• Your use or misuse of the App
• Your violation of this EULA
• Your violation of any law or regulation
• Your violation of any third-party rights
• Any content you submit or transmit through the App
• Your negligent or willful misconduct

11. Updates and Modifications

11.1 App Updates

We may release updates, patches, or new versions of the App to:

• Fix bugs and improve performance
• Add new features or functionality
• Address security vulnerabilities
• Comply with legal requirements

You may need to update the App to continue using it. Some updates may be automatic, while others may require manual installation.

11.2 EULA Modifications

We reserve the right to modify this EULA at any time. When we make material changes:

• We will update the "Last Updated" date
• We will notify you through in-app notifications or email
• Your continued use constitutes acceptance of the updated EULA

12. Termination

12.1 Termination by You

You may terminate this EULA at any time by:

• Deleting your account through the App settings
• Uninstalling the App from your device
• Contacting us to request account deletion

12.2 Termination by Us

We may suspend or terminate your license and account immediately if:

• You violate this EULA
• You engage in prohibited conduct
• You use the App for illegal purposes
• We are required to do so by law
• We discontinue the App

12.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ceases
• You must stop using the App and delete it from your devices
• We may delete your account and data within 30 days
• Provisions of this EULA that should survive termination will remain in effect

13. Third-Party Services and Links

13.1 Third-Party Dependencies

ColPath relies on third-party services (Firebase, Mapbox) for its functionality. These services:

• Have their own terms of service and privacy policies
• May change, discontinue, or limit their services
• Are not under our control or responsibility

13.2 External Links

The App may contain links to college websites and other third-party resources. We:

• Do not endorse or guarantee the accuracy of third-party content
• Are not responsible for third-party websites or services
• Recommend reviewing third-party terms and privacy policies

14. Governing Law and Dispute Resolution

14.1 Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction where the Licensor is located, without regard to its conflict of law principles.

14.2 Dispute Resolution Process

In the event of any dispute arising from this EULA or your use of the App:

1. Informal Resolution: Contact us at appteams.ops@gmail.com to resolve the issue informally
2. Mediation: If informal resolution fails, the parties agree to attempt mediation
3. Arbitration/Court: Unresolved disputes may be submitted to binding arbitration or resolved in small claims court

14.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Export Compliance

The App may be subject to export control laws. You agree that you will not:

• Export or re-export the App in violation of any laws
• Use the App in any country subject to trade embargoes
• Use the App if you are on any government prohibited party list

16. Miscellaneous Provisions

16.1 Entire Agreement

This EULA, together with our Privacy Policy and Terms of Service, constitutes the entire agreement between you and ColPath regarding the use of the App and supersedes all prior agreements.

16.2 Severability

If any provision of this EULA is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of this EULA shall not be deemed a waiver of such right or provision.

16.4 Assignment

You may not assign, transfer, or sublicense this EULA without our prior written consent. We may assign this EULA without restriction.

16.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet outages.

16.6 Survival

The following sections shall survive termination of this EULA: Ownership and Intellectual Property, Disclaimers and Warranties, Limitation of Liability, Indemnification, Governing Law, and Miscellaneous Provisions.
